Inheritance in Russia — A Comprehensive Service for Heirs Abroad

When a person who owned assets in Russia passes away, heirs residing outside the country face a complex and intricate legal procedure. Real estate, bank accounts, company shares and other assets in Russia must be transferred by inheritance under Russian law, which requires precise knowledge of laws and procedures. Many foreigners who lived, worked or invested in Russia leave behind property, accounts and business interests that need proper legal handling.

Processing an inheritance from abroad is a serious challenge: the heir must act within strict legal deadlines, deal with multiple Russian government authorities and provide correctly legalized and translated documents. Any delay or error can lead to loss of inheritance rights or significant complication of the process. The Global Docs Pro team specializes in helping heirs residing outside Russia and handles all procedures remotely, from start to finish.

Types of Inheritance in Russia

Inheritance by law

Inheritance by law is the most common type in Russia, applied when there is no will or the will is invalid. The law establishes a clear order of heirs: the first tier includes the spouse, children and parents, who inherit in equal shares. The second tier includes brothers, sisters, grandfathers and grandmothers. The third tier includes uncles, aunts and cousins (who inherit by right of representation). This continues down to the eighth tier of distant relatives. If there are no heirs in any tier, the estate passes to the state as escheat.

Inheritance by will

If the deceased left a will notarized by a Russian notary, the estate is distributed according to it. A will allows the testator to distribute property as desired — to bequeath to a non-relative or disinherit a statutory heir (subject to the compulsory share). The will must be notarized and the testator must have full legal capacity. The notary keeps the original will and registers it in the Unified Wills Register, simplifying its search after death.

Compulsory share

Even if a will disinherits some heirs, Russian law guarantees a compulsory share to certain categories: minor children (under 18), disabled children, the disabled spouse, disabled parents and dependents supported by the deceased. They are entitled to at least half of the share they would have received by law. This protective rule cannot be bypassed even by a will.

Assets That Can Be Inherited in Russia

Real estate

Real estate is the most common asset in inheritance cases: apartments, houses, land plots, commercial property. Transferring ownership requires registration with Rosreestr (the federal registration service) and is possible only after obtaining the certificate of inheritance from the notary. Real estate in Russia is fully governed by Russian law regardless of the heir’s citizenship or residence. We handle all property transfer procedures remotely.

Bank accounts and deposits

Bank accounts and deposits in Russian banks are inherited under Russian law. To recover funds from a deceased person’s account, the certificate of inheritance must be presented to the bank. Some banks allow heirs to withdraw a limited amount for funeral expenses before the certificate is issued. Large amounts can only be withdrawn after full inheritance processing. We work with all Russian banks and help heirs recover funds.

Vehicles

Cars and other vehicles registered in Russia are inherited like real estate. Transferring ownership requires registration with the traffic police (GIBDD) in the new heir’s name after obtaining the certificate. The insurance policy must also be transferred. If the heir intends to sell the vehicle, they can issue a power of attorney for the sale after registration.

Shares in companies (LLC, IE)

If the deceased owned shares in Russian companies (LLC) or operated as an individual entrepreneur (IE), these shares and rights pass to the heirs. Transferring shares requires amendments to the Unified State Register of Legal Entities (USRLE). The company charter may restrict the transfer of shares by inheritance, and other members have a pre-emptive right to purchase. We review charters and handle share transfer procedures.

Intellectual property

Intellectual property rights registered in Russia — patents, trademarks, copyrights — pass to heirs under Russian law. Transfer requires registration with Rospatent. The remaining term of legal protection passes to the heir along with the right to use and license.

Personal property

Furniture, jewelry, works of art, books and other personal belongings are inherited under general rules. Distribution is made by agreement between heirs or by statutory shares. In the absence of a dispute, heirs can divide personal property by mutual consent. In case of disagreement, they go to court.

The Inheritance Process from Abroad — Step by Step

Accepting the inheritance within 6 months

The first and most important step is filing the inheritance acceptance application with the notary within 6 months of the date of death. The deadline is strict and extendable only by court decision. The notary is determined by the deceased’s last place of residence or the location of the most valuable real estate. If the deadline is missed, it can only be restored through court with proof of valid reasons. We ensure timely filing.

Opening the inheritance case with the notary

After the application is filed, the notary opens the inheritance case, checks for a will and determines the circle of heirs. The notary requests documents from all known heirs. If a will is registered in the Unified Register, the notary invites heirs by will and by law. This stage can take several weeks depending on complexity.

Obtaining the death certificate with apostille

The death certificate is the key document for starting inheritance procedures. If issued in Russia, we obtain it from the civil registry (ZAGS) and place an apostille. If issued abroad, it must have an apostille or consular legalization and a certified translation. Without a properly certified death certificate, the inheritance case cannot be opened.

Proving kinship with apostille

Each heir must prove kinship with the deceased: birth certificates (children), marriage certificates (spouse) and other documents. All documents must have an apostille and a certified translation. If issued in Russia, we obtain them from ZAGS. If issued abroad, we arrange legalization and translation. Missing kinship documents is one of the most common problems, and we specialize in solving them.

Notarized power of attorney for our representative

To act on your behalf, a notarized power of attorney for our representative is required. It can be issued at the Russian consulate in your country — the simplest option, since a consular power of attorney does not require an apostille. We prepare the text in Russian and guide you through the issuance process. The power of attorney authorizes filing applications, obtaining documents, signing protocols and representing you before official authorities.

Obtaining the certificate of inheritance

After 6 months and submission of all documents, the notary issues the certificate of inheritance confirming each heir’s right to their share. This is the key document for disposing of inherited assets: registering real estate with Rosreestr, withdrawing money from banks, retitling vehicles.

Registering property rights

The final step is registering rights in the heir’s name: real estate with Rosreestr, vehicles with GIBDD, shares in the USRLE, intellectual property with Rospatent. Each asset type has its own registration procedures. We handle all registration actions and ensure a legally correct transfer of ownership.

Special Cases

Lost documents

Heirs often face a lack of documents: lost birth or marriage certificates, missing real estate documents, a lost will. In such cases, we obtain duplicates from Russian authorities: ZAGS for personal documents, Rosreestr for real estate documents, the Unified Wills Register for finding a will. We have direct contacts with authorities and know the exact procedures for obtaining duplicates.

Disputes between heirs

Disputes between heirs are not uncommon: disagreements about dividing the estate, contesting a will, or shares. In such cases, we recommend trying mediation and amicable resolution first, as court proceedings can be long and expensive. If agreement is impossible, we represent you in Russian courts with evidence and legal arguments.

Finding a will

If there is a suspicion that a will exists but it hasn’t been found, a search can be conducted in the Unified Information System of Notaries. Every will notarized by a Russian notary is registered in this system. We conduct the search on your behalf to determine whether the deceased left a will and which notary holds it. The service is available upon presentation of the death certificate.

Debts of the deceased — important warning

Heirs should know that debts of the deceased are inherited along with the property, within the value of the estate. Debts may include bank loans, taxes and unpaid bills. If debts exceed the value of assets, it may be better to refuse the inheritance. We help comprehensively assess the estate: check for debts, evaluate assets and give informed legal advice before you decide to accept or refuse.
